The petitioner nos.1 & 2 are apprehending arrest for the alleged commission of offence under Sections 498-A, 304-B and 302/34 of the IPC read with Section 4 of the Dowry Pr ohibition Act in G.R. Case No.24 of 2016 of the court of learned J.M.F.C., Dhamnagar, arising out of Dhamnagar P.S. Case No.13 of 2016.

In course of hearing, learned counsel for the petitioners wants to withdraw th e anticipatory bail application of petitioner nos. 1 & 2 with liberty to them to surrender bef ore the lower court and apply for bail, so that their bail application shall be considered and disposed of by the court having jurisdiction to do so.

In that view of the matter, the anticipatory bail application of petitioner no s.1 & 2 is disposed of as withdrawn. However, they are given liberty to surrender before the l earned J.M.F.C., Dhamnagar in the aforesaid case in the first hour within twenty-one working d ays hence and move for bail. On such event, the learned Magistrate shall consider their applic ation for bail in the first hour strictly on the basis of the materials on record. In case of rejection of the bail application, the petitioner nos.1 & 2 may move for bail before the highe r forum on the second hour. On such event, the higher forum shall consider and dispose of the bail application of the petitioner nos.1 & 2 on the same day strictly on the basis of the mate rials on record.
