2. 3.12.2016 The petitioner having been implicated in G.R. Case No.219 of 2016 ar
ising out of Buguda P.S. Case No.236 of 2016 registered for alleged commission of offence unde
r sections 341/294/325/307/506/34 IPC pending in the court of learned J.M.F.C., Buguda has
filed this application under Section 438 of the Cr.P.C. for grant of anticipatory bail.
Learned counsel for the petitioner submits that as against the incident said t
o have taken place on 16.8.2016, present FIR has been lodged on 27.10.2016 when the petitioner
and informant are having the relationship of master and servant and the allegations remain th
at at the dead-hour of night the informant when the informant had been to the house of the pet
itioner for demanding payment of his arrear wages, the petitioner abused and attacked him. He
further submits that the descriptions with regard to the nature of injury are not correct.
Learned Addl. Govt. Advocate opposes the move.
Considering the submission in view of the nature of accusations and ot
her surrounding circumstances of the case, in the absence of any other impediment, it is direc
ted that in the event the petitioner surrenders before the court in seisin of the case within
a period of fifteen days hence and moves for his release on bail, he be released on bail on su
ch terms and conditions as would be deemed just and proper by the said court.
