2. This Writ Petition has been filed by the petitioner with a prayer to direct the Execut
ive Engineer, Drainage Division, Chandikhol opposite party no.3 to finalize the bill of the p
etitioner in respect of the work Renovation of Matia Drain-cum-Creek From RD 00 Km to 5.50 Km
of Jajpur District in Brahmani Baitarani DOAB No.XIV under NABARD Assistance RIDF-XIV (worki
ng RD.0 M to 3060 M) vide Agreement No.14F2/2010-11 within a stipulated period.
3. Learned counsel appearing for the petitioner submitted that the petitioner was awarded
with construction of the aforesaid work vide Agreement No.14F2/2010-11. After completion of t
he work the concerned Asst. Engineer submitted the 3rd R.A and final bill with opposite party
no.3 since long. In the meanwhile final deviation statement has already been approved by the c
ompetent authority. Though the petitioner has filed a representation before the Executive Engi
neer, Drainage Division, Chandikhol opposite party no.3 on 12.11.2014 to finalize her account
s, no action has been taken as yet.
4. Considering the above, this Court disposes of this Writ Petition with a direction to t
he Executive Engineer, Drainage Division, Chandikhol opposite party no.3 to consider the rep
resentation filed by the petitioner under Annexure-3 in accordance with law, as expeditiously
as possible, on production of certified copy of this order, as in the meanwhile the final devi
ation statement has already been approved by the competent authority.
