The petitioner has approached this Court for issuance of direction upon the opposite p
arties to disburse the estimated cost of the work (Farm Pond) under the MGNREGS scheme to the
petitioner.
At the outset, it has been submitted by learned counsel for the State that the petitio
ner has already made representation (Annexure-6) before the Collector, Subarnapur on 12.05.201
5, it seems that the same is pending.
He further submits that the Collector, Subarnapur shall take decision in accordance wi
th law without any further delay.
On such submission, the writ petition is disposed of directing the petitioner to file
fresh representation before the Collector, Subarnapur along with the copy of the writ petition
within three weeks from the date of receipt of certified copy of this order.
The Collector, Subarnapur shall take decision in accordance with law and pass speaking
order within eight weeks from the date of receipt of representation and communicate the same
to the petitioner within the period aforesaid.
Needless to say that if the grievance of the petitioner is found to be genuine as per
the parameter fixed by the State Government, consequential benefit shall be extended to the pe
titioner.
If, however, grievance of the petitioner is not found to be genuine same shall be comm
unicated to the petitioner by passing a speaking order within the period aforesaid.
The writ petition is disposed of accordingly.
