28.8.2015 The instant petition under Article 227 of the Constitution of India is to quas h the order dated 10.8.2006 passed by the learned Civil Judge (Senior Division), Bargarh in C. S. No.112 of 2003. By the said order, the learned trial court allowed the application and impl eaded Sibasankar Hota as one of the defendants. A memo has been filed on 7.2.2 014 stating therein that the newly added defendant no.10- Sibasankar Hota died on 2.1.2014 and his legal heirs are already on record.Thus by efflux of time the petition has become infructuous. Accordingly, the petition is dismissed as infructuous.2
