This appeal by the claimant-appellant is directed against the judgment/award dated 30.
6.2012, passed by the learned 1st Motor Accidents Claimants Tribunal, Jeypore, in MAC Case No.
154 of 2010, awarding an amount of Rs.8000/- as compensation along with interest @ 6% per annu
m from the date of filing of the claim application, till payment. The claimant seeks enhanceme
nt of the compensation amount.
Considering the submissions made by the learned counsel for the parties and keeping in
view the findings of the learned Tribunal as given in the impugned award with regard to the qu
antum of compensation amount awarded and the basis on which the same has been arrived at, I fe
el, the interest of justice would be best served, if the claimant is awarded a further consoli
dated compensation amount of Rs.25,000/-, on which no interest is payable. The impugned award
is modified to the said extent.
The Insurance Company is directed to deposit the further consolidated compensa
tion amount of Rs.25,000/- with the learned Tribunal within six weeks hence, which shall be di
sbursed to the claimant on proper identification.
MACA is accordingly disposed of.
