Heard learned counsel for the parties.
This writ petition has been filed challenging the Demand Notice issued by the Regional Transport Officer, Bhubaneswar, dated 27.2.2013, as per Annexure-3 to the writ petition, demanding tax and penalty for the period from October, 2011 to February, 2013.
As the impugned demand notice is appealable as provided under Section 18 of the OMVT Act, I am not inclined to entertain this writ petition.
If the petitioner files an appeal within two weeks hence, the appellate authority shall consider and dispose of the same on merit. It is open for the petitioner to file application for interim relief before the appellate authority, which shall be considered on its own merit and in accordance with law.
Writ petition is accordingly disposed of.
Issue urgent certified copy as per rules.
