2. It is stated that CIRP of the Corporate Debtor was initiated by

this Tribunal vide order dated 14.09.2017 and the Applicant herein was

appointed as Interim Resolution Professional (IRP) and thereafter as Resolution Professional (RP).

It is stated that the Liquidation of the Corporate Debtor was ordered by this Tribunal on 06.04.2018 in CA/124/CHE/2018 and the Applicant herein was appointed as the Liquidator.

Pursuant to the order of Liquidation, the Applicant caused the

Public Announcement on 11.04.2018 in Form–B of Schedule II by inviting claims from all the stakeholders and fixed the last date for submission of claim as 06.05.2018.

It is stated that the Applicant received a claim from the Sole Financial Creditor for an amount of Rs. 33,26,91,286/- and the amount of Rs. 32,98,54,936/- was admitted.

It is stated that, the Liquidation Bank Account in the name of

M/s. Nag Yang Shoes Private Limited (Under Liquidation) bearing

Account No.506801010033258 was opened on 28.04.2018 with Union Bank of India, Chennai.

It is stated that, the Stakeholders Constitution Committee (SCC)

was not constituted as the regulation came into effect only from 25.07.2019.

It is stated that, the Applicant closed the bank account of the Corporate Debtor on 29.03.2023, since the sale has been completed and all the assets have been realized and distributed as per the Section 53 of

IBC. It is stated that, the Applicant has complied with all the necessary

requirements as per the provisions of IBBI (Liquidation Process) Regulations, 2016.

We have heard Ld. Counsel for the Applicant and perused the

report and synopsis filed by the Liquidator.

It is stated in Form H that no applications are pending before this Tribunal for avoidance, Preferential, Undervalued or Fraudulent Transactions.

perusal of the final report and the Compliance Certificate filed in Form-H by the Applicant, it is seen that the Corporate Debtor has been

completely liquidated. In the circumstances as averred and as prayed

for by the Applicant, an order for dissolution is required to be passed

¶57

by this Tribunal under Section 54 of the IBC, 2016. Accordingly, we

¶58

order for the dissolution of the Corporate Debtor viz., M/s Nag Yang
