1. This application has been filed U/s 12A of the Code on behalf of the RP seeking withdrawal of the main petition bearing CP (IB) No.489/ALD/2019.

2. It is stated by the Ld. Counsel representing the RP that the Resolution has been passed by the CoC in its meeting held on 23.11.2023 at 06:30 PM with 100% voting majority by the sole Financial Creditor/ Petitioner for moving an appropriate application for withdrawal of the main petition.

3. On the basis of the statement made by the Ld. Counsel representing the RP that though in the Form FA there was a mention about the bank guarantee towards the CIRP cost, however a cheque has been issued, which is yet to be deposited, in view of the aforesaid statement made by the Ld. Counsel representing the RP and the averments made in the application, the present application is allowed and the main petition bearing CP (IB) No.489/ALD/2019 is dismissed as withdrawn.

4. Accordingly, IA No.635/2023 stands disposed off.
