IA-3571/2022: No steps appears to have been taken by the IBBI in terms of the order dated 23.03.2023. Issue fresh notice to IBBI returnable on 03.08.2023. The Applicant undertakes to serve notice upon the IBBI through all modes viz. registered post, speed post, courier service and E-mail. Affidavit of service be filed within one week. In the meantime, a further opportunity is granted to IBBI to file its report in terms of the order dated 23.03.2023 within 2 weeks.

The Court Officer and Registrar are directed to send a copy of this order to the General Manager of IBBI forthwith.

It would be open to the Applicant in the IA as also the RP to make a copy of this order available to IBBI.

IB-556/ND/2020: Mr. Tushar Thareja, Ld. Counsel appearing for the Applicant submitted that the arguing counsel is not available and prayed for a short adjournment. At his request, the hearing is deferred to 03.08.2023. In the meantime, the Ld. Counsels for the parties are directed to file written synopsis not exceeding two pages.

The matter has been received on remand back from the Hon’ble NCLAT vide order dated 09.05.2022. If the matter is not argued on behalf of the Applicant on the next date of hearing, the matter will be dismissed for non-prosecution.
