The above Interlocutory Application is filed by the IRP under Section12A of the Insolvency and Bankruptcy Code for withdrawal of the CIRP order passed against the Corporate Debtor. The counsel appearing for the IRP submits that the above matter has been settled between the parties for an amounting of Rs. 12,12.182/- against the total claim of Rs. 26,75,483.32/- which was paid by the corporate debtor. The Resolution Professional also confirmed that he has received the CIRP cost. No COC is constituted by IRP.

In view of the above facts and circumstances, this Bench feels that it is appropriate to allow the above application filed by IRP. Accordingly, the above I.A. No. 2788/2021 is allowed and the CIRP order dated 08.11.2021 passed

against the Corporate Debtor stands withdrawn by relieving the Corporate

Debtor from all the rigours of moratorium.

Hence, the above I.A. 2788/2021 and C.P. 4656/2019 are disposed of.
