This review application has been filed on the basis of a panchanama about which the Applicant has submitted that it was not previously considered by the Committee or the Court or not produced before the Tribunal. We have gone through the report and the order impugned.

Submission of the learned counsel for the Applicant is that in the panchanama, the FTL level is reported as 461.60 meter. The submission of the learned counsel for the Applicant are that the FTL or the diesel tank level has not been clearly mentioned in the report.

We have gone through the report and found that the details have already been mentioned in the report which has been quoted in the order thus there is no substantial change. The Tribunal has concluded by the impugned order in Para 17 & 19 as follows:-

“17. In the conclusion part and the observations, the committee has observed that the apprehension of seepage or contamination of the dams / reservoir due to submergence is unfounded and it is further submitted that the underground tanks and KSK have been

constructed with standard petroleum storage safety norms, which include doubled volved structure, leak proof lining and necessary protective measures to prevent percolation of petroleum products into surrounding soil or ground water. It is further argued that the guidelines for fixation of gates and acquisition of land for dam was issued on 06.08.2020, while the petrol pump was established in the year 2015.

We have to see as to whether there are any violation and since this unit was established in 2015 and guidelines issued by the CPCB is of 2020 or thereafter, thus the guideline is not from the retrospective date. The rules are to be effective from the prospective dates. Further the allotment of the petrol pump and providing the land and its criteria it will be followed by the authorities concerned and it is for the respondent to decide it according to rules as a matter of policy. At present there are no violation thus, no further action is required to be taken by this Tribunal.”

In view of the above facts, no substantial ground has been made out and there is no evidence which was not discussed during the proceedings. Thus, there is no ground to recall or review the order.

The application has no merit to interfere, thus, Review Application No.13/2026(CZ) stands disposed of accordingly.
