(Review Application No.09/2025(CZ) & Review Application No.10/2025(CZ)):

In the present Review Applications, the Review Applicants have raised certain technical and typographical errors to be corrected.

We have gone through the records and perused the order and relevant directions.

The order dated 03.11.2025 direction number (iv) in para 95 relates to the blasting, thus it is corrected that in the last sentence (4^th line from 1

below) the word “mining” be deleted and substituted by word

“controlled blasting”. Para 95 (iv) now be read as follows:-

“(iv) Considering the fact that ambiguity prevails as regards distance of schools and houses of locals from mining site, therefore, the Department of Mines and Geology, State of Rajasthan, and the Collector concerned are directed to demarcate the line on ground from 500 meters from the village establishments including school impartially and ensure that no blasting shall be permitted within the 500 meters radial distance from temples, offices, dwellings, schools structures belonging or not belonging to owner, which may cause damage to the property or cause injury to the persons or anyone. The controlled blasting shall work only in one shift during day shift hours with necessary safeguards. There must be specific indication of Danger Zone and proper distinct warning by a siren be given for the purpose within the Danger Zone.”

Similarly, the direction number (vii) in para 95, it is clarified that it is a regulatory and not a prohibitory subject to guidelines. This para does not put any restriction on the mining as prescribed in the guidelines and Environmental Clearance conditions.

The direction number (xiii) in para 95, 7^th line after “(total number shown as) to the Collector concerned”, the words “within three months from today” be added. Para 95 (xiii) now be read as follows:-

“(xiii) Every person from the list of Annexure-A20 of Original Application No.144/2024(CZ) are entitled for payment of total 20,000/- (Rupees Twenty Thousand only) as the environmental damage and health impact to be paid from the CSR fund. The Project Proponent/Ultratech Cement Ltd. is directed to deposit the said amount in accordance with the list of Annexure-A20 (total number shown as 298) to the Collector concerned within three months from today, who will, after verifying the matter, pay and disburse the amount to the affected persons. The Collector is further directed to make necessary provisions for medical facilities to the villagers being affected by the mining with the provisions of medicines free of cost and regular check-up at the interval of two weeks and further provisions for regular and permanent facility of treatment to the

affected persons at the nearby place. The amount of DMF and the CSR funds may be utilized for the purpose.”

The last issue as raised by the Review Applicants is with regard to the distance of blasting. In paragraph 95 as quoted, the direction is upto 500 meters but the contention of the Review Applicants is that it relates to the limit and distance prescribed by the DGMS. Now the question with regard to the admissibility of the distance criteria is on two points:-

(a) Mining near the abadi side or school etc = as per rule, guidelines and EC conditions;

(b) Controlled blasting distance = 500 meters with permission of DGMS,

The prayer with regard to distance criteria in Review No.09/2025(CZ) and Review Application No.10/2025(CZ) is resolved accordingly. The technical/typographical errors with regard to the period of payment of compensation and blasting have been considered and suitably amended.

(Review Application No.11/2025(CZ)):

This Review Application has been filed by the Review Applicant, Jodhpura Sangarsh Samiti with the prayer to review and recall the order dated 03.11.2025 passed in Original Application No.143/2024(CZ) to the extent of para 95 (iv) which is quoted in para 3 above as corrected today.

It is clarified that these directions have been issued with regard to blasting and being the above lines, we have after examining the Review Application No.09/2025(CZ) and Review Application No.10/2025(CZ), and in place of “mining” it has been amended as a “controlled blasting”.

Submissions of the Review Applicant are that the blasting shall not be permitted, but since there are requisite permissions from the DGMS and Unit is functioning as per the norms fixed by the DGMS. Thus, we are not of the view to intervene in the matter. The above order was passed after due consideration and arguments heard by the parties concerned and there is no basis to recall the said order quoted above.

The Review No.09/2025(CZ), Review Application No.10/2025(CZ) and Review Application No.11/2025(CZ) are disposed of accordingly.
