The applicant-Mr. Arun Kumar Giri has sent the present letter petition dated 18.10.2025 by speed post to this Tribunal which has been treated and registered as O.A. No.69/2026/EZ for exercise of suo-motu jurisdiction in view of law laid down by Hon’ble Supreme Court in Municipal Corporation of Greater Mumbai Versus Ankita Sinha and others, (2022) 13 SCC 401 .

The applicant has raised grievances regarding illegal filling of the doba (pond/water body on plot no. 871) village Gobardhanpur Mouza, Chandipur Police Station, Purba Medinipur District.

The applicant did not appear before this Tribunal on 02.04.2026.

Vide order dated 02.04.2026, the Registry was directed to intimate

the applicant about the date of hearing fixed and to ask him to appear physically or through VC and to produce the material available with him

in support of the averments made in the O.A. before this Tribunal.

The applicant has appeared through his Counsel but the applicant has not produced the material available with him in support of the averments made in the letter petition which has been treated as Original Application.

Learned Counsel for the applicant seeks permission to withdraw the present Original Application with liberty to file fresh Original application on the same cause of action in the prescribed format with requisite factual details by impleading necessary parties and enclosing copies of relevant documents.

In view of the above, the present original application is dismissed
