This matter relates to illegal discharge of sewage water by Respondent no. 4/Mansarovar Dental and Ayurvedic Medical College in open and on agriculture land at village Hinotiya Alam, Apni Milan Colony. This waste water flows to agricultural land, residential colonies and joins the canal water being used by the farmers for irrigations purpose, foul smell emits from the waste water causing damage to the environment, standing crops and serious health hazards to the local residents.

An inspection report has been filed on behalf of respondent no.2/ Madhya Pradesh Pollution Control Board, which begins from page no. 15 of the paper book, wherein it is observed that waste water generated from the Dental chairs and other operational area is conveyed through the internal drainage network to the effluent treatment plant of 25 KLD capacity. The said plant was found in operation at the time of inspection.

An application has been submitted to Respondent no. 3/Bhopal Municipal Corporation for permission to connect the institution’s sewage network to the nearby municipal sewage line. As of now, no discharge of untreated water is taking place outside the premises. Treated Effluent sample was collected from the treated water holding tank of ETP and the Lab reports found that the results were complying with the prescribed physico-chemical discharge standards under the consent conditions, so as per this site inspection report the Madhya Pradesh State Pollution Control Board did not find any violation.

From the side of the respondent no. 1/District Collector Bhopal learned counsel Mr. Prashant M. Harne is present and states that he does not want to file the reply and would rely on the site inspection report.

The Respondent no. 2/Member Secretary, State Pollution Control Board is being represented today by learned counsel Mr. Pranjal Pandey and is relying on the site inspection report.

From the side of the respondent no. 3/Bhopal Municipal Corporation, Learned Counsel Mr. Om Shankar Shrivastava is present and says that he would be relying on the site inspection report.

The Project Proponent/Respondent no. 4 Mansarovar Dental and Ayurvedic College, learned Counsel Mr. Ayush Dev Bajpai is present and states that he has filed reply affidavit today only but we do not find the same on record. The learned counsel states that in the reply he has reiterated the same facts which have been mentioned in the site inspection report. He further stated that in the site inspection report no pollution has been found to have been caused from the side of respondent no. 4.

The applicant is not present today nor is he represented through the counsel. Therefore, we do not see any reason as to why this original application be further kept pending.

In view of the site inspection report submitted by the MPPCB, we are of the view that this matter deserves to be closed and accordingly we dispose of this original application.
