In this Original Application (OA), the applicant has made a prayer seeking a direction to the Respondent No. 3 – Municipal Corporation of Gurugram for dismantling/sealing pipeline being laid for discharge of STP treated water. The plea of the applicant is that the Respondent No. 3 is undertaking the construction and laying of the pipeline and is likely to discharge partially treated sewage/wastewater from the STP situated at Village Balola, District Gurugram in a natural waterbody. Further plea of the applicant is that the pipeline is being laid in the forest area.

So far as the issue of laying of the pipelines in the forest area is concerned the Forest Department has already taken an action and the document concerning seizure of the pipeline which was being laid affecting the Aravalli Forest area is already on record on Page No. 245. The counsel for the applicant has submitted that the treated water which is being discharged in the natural waterbody is not meeting the prescribed standard but in support of such an allegation no material has been showed, even otherwise it is the responsibility of the concerned Pollution

Control Board to regularly monitor the performance of the STP and ensure that the STP treated water meets the prescribed norms. So far as the submission of the counsel for the applicant that no CTE/CTO has been obtained for setting up the STP, no pleadings could be pointed out in support of such a submission.

In view of the above and considering the fact that one opportunity has already been granted by the Tribunal earlier to place on record the relevant material and in spite of the same no relevant material indicating violation of any environmental norms could be pointed out, we do not find any ground to interfere in this OA which is accordingly dismissed.
