This petition has been taken on the basis of news reporting in DB Star

Bhopal Newspaper dated 06.08.2026 titled as ‘Ab Rat Me Bhi Avaidh

Khanan’ . The facts as narrated are that :

“The Mining Department has failed to take effective action against illegal mining. Near Radharaman College in Ratibad. The copra quarries in village chappar had been lying closed for 10 Years, but illegal mining has now restarted.

The illegal mining begins as soon as darkness falls and continues until dawn. Every night, approximately eight to twelve

truckloads of copra are extracted. Suppliers' trucks are loaded at the site at a rate of Rs.3 per cubic foot.

It is further submitted that the village of Chapari is located barely 100 meters from the site of the alleged illegal mining. Due to the night-time mining operations, Poclain machines and trucks operate throughout the night, depriving residents of sleep. Moreover, the village's dirt roads have been severely damaged, and a deep ditch has formed near the village, posing a serious risk to local residents.”

Matter is of great concern. In spite of repeated orders, guidelines issued by the MoEF&CC namely Sustainable Sand Mining Management Guideline 2016 and Enforcement & Monitoring Guidelines for Sand Mining 2020, the mining department has failed to exercise his duties sincerely and properly and failed to control illegal mining, which is required strict vigil through technical assistance.

Accordingly, we forward the copy of the news reporting with the copy of the order to the Director, Mining and the Collector Bhopal for directing the officers concern having responsibility to control the illegal mining to make a surprise visit and to immediately stop the illegal mining and in case illegal mining is found to be operational then the penalty as per the Madhya Pradesh Sand Mining Rules may be realized and deposited to the State exchequer. State PCB is directed to monitor the illegal mining and take necessary actions and to calculate and realize the environmental damage, compensation according to rules. Copy of this order be forwarded to Director Mining, Collector Bhopal and Member Secretary, State Pollution Control Board for taking proper and necessary actions.
