In this Original Application, the applicant has alleged that Respondent No. 4 to 6 are operating the Ready Mix Concrete Plant in village Bissar Akbarpur and village Kota Khandewla. The applicant alleges that these respondents do not have the requisite Consent to Operate and Consent to Establish from the HSPCB and they are violating the siting criteria, violating the environmental norms and creating air pollution causing health hazard.

The counsel for the applicant pointed out that the complaint has already been made to the RO, Nuh HSPCB on 27.11.2025 but till now no effective action at the ground level has been taken and these respondents are operating RMCs violating all the environmental norms.

Sh. Rahul Khurana, learned counsel appearing for the Respondent No. 1-HSPCB submits that the complaint of the applicant will be duly looked into and requisite action will be taken within a period of four weeks.

The HSPCB is directed to carry out the spot verification, ascertain if these respondents are operating the RMCs without requisite environmental clearance and if the allegation is found to be correct, the HSPCB will ensure their closure and levy of environmental compensation for past violations by following the due process of law. The HSPCB is directed to submit the action taken report within three months before the Registrar General of the Tribunal via email at [email protected], preferably in the form of a searchable PDF/OCR-supported PDF and not in the form of an Image PDF. If deemed necessary, the matter will be listed for consideration before the bench again.
