The applicant filed present execution application for execution of order dated 16.08.2024 passed in Original Application No. 465/2023 titled Ashish Sharma vs. State of U.P. & Ors.

The above said E.A. was disposed of vide order dated 16.02.2026 with the directions to respondent no. 4 to file compliance report by 10.05.2026 before the Ld. Registrar General of this Tribunal who was given liberty to place the matter before the Bench if further directions were considered to be necessary.

In compliance thereof, compliance report dated 13.02.2026 was filed by respondent no. 4. The relevant part of the report reads as under:-

“3. That as per the directions passed by this Hon'ble Tribunal and the undertaking given by the Respondent No. 4, the work of shifting of the OWC machines to the newly developed and agreed location was undertaken at war footing and the entire work including shifting of the OWC machines and re-fabrication of ducting from this location till beyond 25th Floor is complete along with requisite components like fans, grills etc. are ready to use.

4. This is to submit that at present, the entire system is being tested and the plant shall be made fully operational at the new site by 11.05.2026. The photographs depicting shifted OWC machines and the related equipment are being annexed herewith as Appendix-2 (Colly) for the kind perusal of this Hon'ble Tribunal.”

Considering further orders to be necessary the matter has been listed before the Bench by the Registry by registering the report as M.A. No. 47/2026.

We have heard learned Counsel for the parties and gone through the report.

¶27

Learned counsel for respondent no. 4 has submitted that the plant which was to be made fully operational at the new site by 11.05.2026 has been made operational.

Learned counsel for the applicant has submitted that the compliance may be got verified.

The present miscellaneous application is disposed of with direction to UPPCB to verify the compliance status with respect to environmental norms and statements made before this Tribunal and in case of any violation, take appropriate action in accordance with law by giving opportunity of being heard to the applicant and also the respondent no. 4- project proponent.

In case any grievance of the applicant survives, the applicant shall be at liberty to move this Tribunal by way of appropriate proceedings.
