This Original application (OA), registered on the basis of a letter petition sent by one of the residents of Nagar Panchayat Gauri Bazar, District Deoria, Uttar Pradesh.

Grievance raised relates to illegal discharge of untreated commercial waste water in Kurna Nala, a tributary of river Ganga near industrial area, Usra Bazar, District Deoria, Uttar Pradesh.

Applicant has alleged that industrial discharge was in violation of the environmental norms and was creating health Hazard to the local residents.

Tribunal by order dated 28.03.2025 had impleaded the respondents and had issued notices to them.

UPPCB had initially filed the reply dated 30.07.2025 disclosing that during the inspection undertaken by officials of UPPCB of the industrial area of Usra Bazar, it was found that M/s Forever Distillery Pvt. Ltd. was established and operating in that area which was main water polluting

industry, therefore, inspection of M/s Forever Distillery Pvt. Ltd. was done on 10.07.2025 and it was found that the unit had obtained EC on 21.09.2024, Consent To Establish (CTE) on 10.05.2024 and Consent To Operate (CTO) on 26.12.2024. It was further found that unit had provided Condensate Polishing Unit (CPU) for purifying the effluents generated from other processes and unit is based on zero liquid discharge and during the inspection, no effluent was found to be discharged from the industry.

Tribunal in the order dated 31.07.2025 had considered the report of UPPCB dated 30.07.2025 and had found that unit was discharging 18 KLD domestic waste which was treated in the STP but the details of the STP treated water were not disclosed.

In terms of the above, UPPCB has filed the fresh report dated 28.10.2025 disclosing the details of the STP and also disclosing that samples of trade effluent from the STP were collected and analysed in the laboratory of RO, UPPCB, Gorakhpur, UP and same have been found in accordance with the prescribed norms.

In the two reports which have been placed on record, compliance of EC and other CTE and CTO conditions have not been reflected. Hence, we dispose of this OA directing the UPPCB to ascertain the compliance of EC and CTO conditions by the unit in question and submit the action taken report before the Registrar General of the Tribunal by email at [email protected], within three months. If found necessary, the matter will be listed for consideration before the bench again.
