‘Steel Furnace Association of India (SFAI) through its Vice Chairman Mr. Vivek Singh’ made the present complaint on Public Grievance Portal of this Tribunal, which has been treated and registered as O.A. No. 603/2025 for exercise of suo moto jurisdiction in view of law laid down by Hon’ble

Supreme Court in Municipal Corporation of Greater Mumbai vs. Ankita Sinha, (2022) 13 SCC 401.

The original application has been registered with title in the name of ‘Vivek Singh ‘ personally instead of registering the same in the name of ‘Steel Furnace Association of India (SFAI) through its Vice Chairman Mr. Vivek Singh’ and title of the original application is ordered to be corrected accordingly.

“Subject: Urgent Appeal Regarding Non-Implementation of NGT Order, Escalating Environmental Pollution, and Risks to Public Health in Delhi's Industrial Areas.

Respected Hon'ble Justices,

We write to urgently seek the intervention of this Hon'ble Court concerning the ongoing violations of environmental regulations and the nonenforcement of order issued by the Hon'ble National Green Tribunal (NGT) in Delhi. Despite clear and unequivocal directions, environmental degradation continues unchecked, jeopardizing the health and well-being of the public.

It is concerning that despite the NGT's order on 16.10.2018, which mandated the immediate closure of illegal hazardous pickling units, authorities have failed to take any meaningful action. Several such units remain operational, contributing to serious air, water, and soil pollution, while endangering the health of the residents of Delhi. The continuing inaction and negligence of the Delhi Police, Delhi Government bodies, Revenue Department, Delhi Pollution Control Committee (DPCC), and other regulatory agencies have led to a significant breach of judicial order. Pickling processes typically use hazardous chemicals such as Hydrochloric and Sulphuric Acid, which produce harmful emissions and hazardous waste that affect air quality, contaminate local soil and water resources. These pollutants also harm essential ecosystems, including the Yamuna River.

All this happening even after imposition of penalty of Rs. 50 Crores by Hon'ble NGT vide order dated 16.10.2018.

1. Issue Overview

Multiple illegal hazardous industries, including pickling units, hot re-rolling mills, and fuel-based industries, continue to operate across various industrial zones in Delhi, including:

One such example is a hot re-rolling mill near Ram Mandir in Siraspur, operated by a former MLA's tenant, which illegally uses banned fuels like tyre oil and furnace oil, causing severe air pollution. Despite numerous complaints, the unit continues to release hazardous emissions, worsening the environmental crisis.

These industries continue their operations despite their harmful effects, discharging untreated waste, including toxic acids and banned fuels, into public drainage systems. This leads to significant environmental harm, with banned fuels such as rubber oil, furnace oil, and tyre oil contributing to the release of dangerous pollutants like Particulate Matter (PM2.5 and PM10), Sulphur Dioxide (SOD), and other harmful substances, worsening Delhi's air pollution.

3. Administrative Inaction and Corruption

There is clear evidence of systemic negligence and corruption within the enforcement agencies. Government officials responsible for inspections have been found guilty of:

- Providing advance notice to industries prior to inspections, allowing them to escape enforcement actions.

- Issuing fraudulent permits and clearance certificates.

¶48

Suppressing public complaints and altering reports to hide violations. This corruption has allowed the unchecked operation of these polluting industries, hindering efforts to protect both the environment and public health.

4. Request for Judicial Action

In light of the serious environmental and public health risks, as well as the blatant disregard for judicial order, we respectfully request the Hon'ble Supreme Court, Delhi High Court, and NGT to:

A.Take suo-motu cognizance of the issue and summon relevant authorities, including the Commissioner of Police, Chief Secretary of Delhi, Divisional Commissioner, Secretary of Environment, and DPCC officials, for their failure to enforce the NGT's order.

B. Initiate Contempt of Court proceedings against the responsible government bodies for not complying with the NGT's order dated 16.10.2018.

C. Order the immediate and permanent closure of all illegal pickling units, hot re-rolling mills, and industries using prohibited fuels in NCT Delhi. D. Establish a High-Level Judicial Monitoring Committee to ensure the proper enforcement of court order and oversee the closure of illegal industries.

E. Direct the Central Bureau of Investigation (CBI) or an independent Special Investigation Team (SIT) to investigate the unlawful operations of these hazardous industries.

5. Conclusion

The ongoing pollution caused by these industries constitutes a severe environmental and public health emergency. We respectfully urge the Hon'ble Judiciary to intervene without delay in order to protect public health, enforce environmental laws, and restore faith in the judicial process.”

The applicant has not appeared today personally or through authorized representative.

We have gone through the original application.

The applicant is seeking execution of order dated 16.10.2018 passed by this Tribunal in Execution Application No. 11/2017 in O.A No. 159/2013 and O.A. No. 77/2016, All India Lokadhikar Sangathan v. Govt. of NCT of Delhi & Ors.

In view thereof, execution application will lie for execution of orders passed by this Tribunal and present original application is not maintainable.

Since the applicant is an association of Steel Furnace Industries and presumably has sufficient financial and human resources to file proper execution application by giving requisite details, impleading the violators and enclosing copies of the relevant documents/material available in support of its claim of non-compliance with the orders passed by this Tribunal, we are of the considered view that cognizance need not be taken by this Tribunal suo moto by converting the present original application as execution application and the applicant may be asked to file proper execution application by giving requisite details, impleading the violators and enclosing copies of the relevant documents/material available in support of its claim of non-compliance with the orders passed by this Tribunal.

The present original application is disposed of accordingly with liberty to file proper execution application in accordance with law.
