The matter was initiated on the basis of paper reporting with regard to encroachment on Khasra no. 36. Submission of the applicant are that it is a forest land and nallah and there are encroachments. In response to the above, the respondent no. 2 Asst. Director Horticulture has filed the reply with the contention that Badh ka Baag Nursery, Umrain (Alwar) is operated under the horticulture department Alwar and above plot number is in possession and use and recorded in the name of irrigation department and also in the Jamabandi/Khasra. It is further contended that during the settlement process the land was erroneously re-allocated to the forest department and a claim for correction of records is presently pending before the Court of Civil Judge, Alwar. The matter with regard to above facts are also complained before the Sub Divisional Magistrate 1

and Police Station. Since the matter of dispute is with regard to right title and interest of two government departments, thus, it is not desirable to proceed further only on the basis of drainage which was added to draw this application within the domain of this Tribunal. Since the matter is purely of Civil nature and pending before the Court of Civil Judge, thus, no further action is required by this Tribunal till the right title and interest of the authorities are decided by the competent court.

Accordingly, the parties are directed to approach the appropriate forum/Civil Judge where the matter is pending for proper and efficacious remedy. The facts as narrated in the application are not maintainable before this Tribunal.

The O.A. No. 257/2024 (CZ) along with I.A No. 20/2025 stands disposed of accordingly.
