under MSRDC has been constituted as a Special Planning Authority as per the provisions of Section 40 of the MRTP Act, 1966. Therefore, if any action is to be taken, the same has to be taken by the Planning Authority and not by the Collector. The direction was issued to the Tahsildar, Mahabaleshwar to submit a report and it is revealed that at Survey No.1/43, there is a kachcha construction admeasuring approx.. 20 x 15 feet. In survey No.2/1, new construction has been started admeasuring approx. 60 x 24 feet. Similarly, two small houses are constructed in Survey No.2/12. The total area of each house is 100 x 25 feet approximately, which is pakka construction utilized for the purpose of residence. In Survey No.2/1, pakka construction admeasuring 35 x 30 feet covered with black iron patra has been made. The Circle Officer did not notice any illegal felling of trees, rather several trees have been planted. Further it is mentioned that Chandrakant Raoji Walvi and Aditya Chandrakant Walvi and one Nandu Namdevrao Lekhe has made a statement that Survey Nos.1/10, 1/19, 1/24, 1/130, 1/31, ¼, 1/40, 1/7, 1/9, 11/3, 13/11, 13/19, 13/20, 13/22, 13/31, 15/1, 15/19, 15/21, 15/24, 15/6, 2/12, 2/13, 2/2, 9, 10/1, 1/1, 20, 3, 5, 8 were purchased by them. No illegal resort has been constructed in his name nor any illegal mining or illegal cutting of trees was going on. They have developed the old existing structure. The purchasers have violated the Agricultural Ceiling Act.
