We are passing this order in continuation to the earlier order dated 21.10.2024.

In compliance with the earlier order dated 21.10.2024, respondent Nos.1 & 2 has filed reply affidavit dated 18.10.2024, stating therein that news article contains several inaccuracies and misunderstandings. In fact, there are some encroachments by tribal communities within Tungareshwar Wildlife Sanctuary (TWLS) for agriculture and housing purposes. These communities have submitted claims for Individual Forest Rights (IFR) and Community Forest Rights (CFR) under the provisions of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006. Details of the same are given as Annexure- I, as follows:-

In the above affidavit, mention is also made that within the boundaries of Tungareshwar Wildlife Sanctuary (TWLS), a segment of forest land has been encroached upon by Shri Balayogi Sadanandbaba Ashram, for which interim protection has been given by the Supreme Court in I.A. No.19010/2019 of W.P 202/1995 (T.N. Godavarman Vs Union of India & Others ). It is further mentioned that news article contains the fact with respect to there being “four major watering holes”, is also denied in this affidavit. The other facts, which are mentioned in the news article, are found to be untrue.

In view above, we find that there is no ground to pass any direction in this matter and hence, we dispose of this application accordingly.
