the Forest Conservation Act, 1980 from Respondent No.1; consent to operate and establish under the Air (Prevention and Control of Pollution) Act, 1981 or consent including consent to establish under Section 25 of the Water (Prevention and Control of Pollution) Act, 1974 from respondent no.5 and (iii) any trade license (if permitted) from respondent no.6. They have deployed heavy machinery and equipment, including but not limited to earth-moving equipment (JCB's), dumpers, trucks for carrying out frequent ingress and egress of sand, minor minerals (small concrete stones), etc., throughout the day and night. Due to loading, unloading and use of JCB, cranes, etc., at the Subject Land severe noise pollution is also being caused. Entire sand and minor minerals (small concrete stones), etc., are stored and/or dumped in open air from which dust emanate on continuous basis gravely polluting the environment by causing severe air pollution and thereby acting as grave health hazard to the health and well-being of the Applicants and their families living in Lakewood Colony as well as the members of the neighbouring societies. The forest cover has been gradually reduced, over the period of years, on account of the said illegal activities, rendering the Subject Land almost barren and there is also apparent degradation of soil.
