This M.A. was filed by the applicant seeking compliance of the order of the Tribunal dated 08.03.2021 passed in Execution Application No. 46/2018 in OA No. 234/2015.

The Tribunal by the order dated 14.07.2025 had permitted the applicant to convert this Miscellaneous Application into Execution Application.

The applicant has now filed a fresh Execution Application, therefore, no further orders are required to be passed in this M.A. which is accordingly disposed of.

This Execution Application has been filed by the applicant seeking compliance of the order dated 08.03.2021 passed in Execution Application No. 46/2018 in OA No. 234/2015.

The OA involved the issue of restoration of Khanua Nala (drain) at Chapra, District Saran, State of Bihar. The earlier EA was disposed by the Tribunal by order dated 08.03.2021 by directing as under: -

“8. In view of above, we direct the Secretary, Urban Development to ensure further action by continuous monitoring to uphold the rule of law and for protection of environment and public health. It may be particularly ensured that the flow of the drain is not obstructed by the reduction in the width and by the encroachments. The Nagar Nigam, Chapra and the District Magistrate, Saran may take action on the ground and comply with directions of the Secretary, Urban Development on the subject. We also request the Chief Secretary, Bihar, to monitor the situation at east once in six months till the situation improves. The applicant is at liberty to represent to the authorities, if any further grievance survives.”

Applicant submits that the above direction of the Tribunal has not been complied with and the encroachment still exists on the drain affecting the flow of the drain. In support of his submission, he has placed reliance upon the photographs enclosed along with the Execution Application.

Issue notice to the respondents. Applicant is directed to serve the respondents and file the affidavit of service at least one week before the next date of hearing.
