This MA has been registered on the basis of the action taken report dated 12.07.2024 submitted by the Uttar Pradesh Pollution Control Board (UPPCB) in compliance of the order dated 04.03.2024 passed in OA No. 189/2024.

The OA was registered suo motu on the basis of the news item disclosing that bio-medical waste was lying scattered in the compound of Bagla Combined District Hospital, Hathras, Uttar Pradesh.

The Tribunal in the order dated 04.03.2024 had considered the report dated 01.03.2024 submitted by the UPPCB on advance notice and had disposed of the OA directing as under:

In compliance of the above direction, the report dated 12.07.2024 has been submitted by the UPPCB disclosing as under:

1. U.P. Pollution Control Board has imposed environmental compensation of Rs. 9,97,200/-(Rupees Nine Lakh Ninety Seven Thousand Two Hundred) against M/s Bagla Joint District Male Hospital, Hathras vide letter dated 30/05/2024. A reminder letter dated 29.06.2024 has been issued to the M/s Bagla Joint District Male Hospital, Hathras with direction to deposit the imposed environmental compensation. The copy of the letters dated 30.05.2024 and 29.6.2024 are enclosed as Annexure-1 and 2 along with this Action Taken Report.

2. U.P. Pollution Control Board has imposed environmental compensation of Rs. 12,91,200/- (Rupees Twelve Lakh Ninety One Thousand Two Hundred) against M/s District Women Hospital, Hathras vide letter dated 07.06.2024. A reminder letter dated 29.06.2024 has been issued to the M/s District Women Hospital, Hathras with direction to deposit the imposed environmental compensation. The copy of the letters dated 07.06.2024 and 29.6.2024 are enclosed as Annexure-3 and 4 along with this Action Taken Report.”

The above report discloses that though the environmental compensation has been imposed upon M/s. Bagla Joint District Male/Female Hospital, Hathras, but the report does not disclose that any efforts have been made in accordance with law by the UPPCB to recover the environmental compensation amount. The report also does not disclose that the problem which was reflected in the news item has been remediated.

Learned Counsel for the UPPCB submits that within a week communication will be sent to the concerned District Magistrate for recovery of the environmental compensation amount and that fresh inspection of the premises of Bagla Combined District Hospital, Hathras

will be carried out to ascertain if the biomedical waste is still lying scattered in the premises of the hospital.

Hence, we dispose of the MA directing the UPPCB to file a fresh action taken report within three months before the Registrar General of the Tribunal disclosing the status of recovery of environmental compensation amount and also the current status of the bio-medical waste, if any, lying scattered in the premises of the hospital in question. If it is found necessary, the matter will be listed for consideration before the Bench again.
