This is an Miscellaneous Application with the prayer to clarify the word written in para 13 of the order passed by this Tribunal on 27.09.2024 in O.A. No. 81 of 2024 (CZ). We have gone through the order and operative portion passed in O.A No. 81 of 2024(CZ) which is as follows :

“ 12. A perusal of the record discloses that the work is being done by the orders and consent order issued by the State Administration and State Government, Collector, State Pollution Control Board after assessment of the report submitted by the Expert Committee. The matter was directly and substantially in issue in the High Court and the material placed before the Hon’ble High Court was not found to interfere with.

13. In view of the above facts, we direct that the decision taken by the District Administration/Collector shall be

monitored by the following committee and must be completed within the monitoring of this committee according to rules so that there shall not be any adverse effect on biodiversity and free flow of the river water. The members of the committee are :

i. One representative from the Housing and Environment, Govt. of Chhattisgarh, /Collector concerned, (C.G.)

ii. One representative from the Chhattisgarh State Biodiversity Board, (C.G.)

¶19

iii. One representative from the Divisional Forest Officer, Dantewada, Division Dantewada (C.G.)

iv. One representative from the Chhattisgarh Environment Conservation Board (C.G.)”

We have also examined the order impugned and application moved

by an applicant and we do not find any merit in this Miscellaneous Application to intervene in the order. However, we direct the applicant to move an application before the competent committee as narrated in para 13 for redressal of his grievances.

At present there is no material to intervene in the order. The Miscellaneous Application No. 20/2024(CZ) stands disposed of accordingly.
