This application has been preferred for the preservation and Conservation of the Rivulet/Stream of Water Chawandi, passing through villages Joria, Turkiyawaas, Gokalpur in Tehsil Kotkasim, District Khairthal-Tijara in the State of Rajasthan. It is alleged that the erring Respondent Gram Panchayat Joria, Panchayat Samiti Kotkasim, through its Sarpanch is illegally constructing underground waste water pipeline and engaged in diversion of village water Naala towards western side which shall meet rivulet Chawandi. It is pertinent to mention here that, this Rivulet Chawandi Water Stream is an important tributary of River Sabi. The work of underground pipeline from Joria is in full swing, being violative of environment and its ecology. This will directly affect several villages, i.e., Joria, Turkiyawaas, Gokalpur, etc and their agricultural land will be

polluted. The drinking and irrigating water of above villages will be contaminated not left for drinking and irrigation purpose. The action on the part of Respondents is in violation of the Water (Prevention and Control of Pollution) Act, 1974.

The matter was taken up by this Tribunal and a Joint Committee was constituted comprising of; Collector, District Khairthal-Tijara and Member Secretary, Rajasthan State Pollution Control Board with direction to submit the factual and action taken report.

In compliance of the order, Rajasthan SPCB vide communication dated 01.01.2025 filed the report as follows:-

“It was intimated by villagers that the village Joria was facing severe issue of drainage of water and this water was getting collected on main road passing through the village. Due to this there was a long lasting issue of water logging/accumulation therefore villagers were facing inconveniences since long. On the date of visit work of laying of underground pipeline for drainage of water was completed and civil work at terminal point, located within rivulet/stream Chawandi was in progress. The water from village drain was also diverted into said underground pipe line but it was not reaching up to terminal point.

Details about the work of diversion of water through underground pipeline up to Rivulet/Stream of Water Chawandi were collected and are as under-

1- As per census 2011, village Joria is having population 4167.

2- Sources of raw water for the village are PHED water supply and own bores constructed in many houses. As per information given by Junior Engineer PHED, for purpose of water supply Department has constructed 02 elevated service reservoir of capacity 270 KL & 200 KL. At present total water supply is around 370 KLD. This water is also abstracted from ground through bores.

4- No industrial activity has been observed or reported in the village. However, very few commercial activities in form of shops were observed in scattered locations.

5- It was reported by villagers that for disposal of black water (coming from WCs) septic tanks have been constructed in individual households. However, gray water (from other domestic usages) is terminated into open public drain flowing adjoining to the houses of village.

6- In absence of proper drainage and terminal disposal facilities, water from these drains was terminated on roads creating water logging since long.

7- Considering the issue of drainage and water accumulation on roads, Zila Parishad Alwar planned drainage work by providing closed pipeline from selected terminal point of drain up to Rivulet/Stream Chawandi. According 04 sanctioned amounting INR 1000000/- each [Total 40 Lacs] were issued on 19-122023. As per contents of sanction letters the drainage were ultimately terminated in river Chawandi.

8- Site of termination point of this line was also visited and it was gathered/ found that river Chawandi is a nonperinea! natural rivulet/stream through which run off water of this area is drained during rainy season. As per information this natural rivulet/stream ultimately joins river Sabi.

9- Village Turkiyavaas & Gokulpura are located in downstream of terminal point of this drainage pipe line.

I0- The path of this natural rivulet/stream Chawandi is surrounded by agriculture fields. During visit natural rivulet/stream site, neither any water was observed terminating from drainage pipe line nor the rivulet/stream was having any water.

11- This drainage work is having underground pipeline of about 1.25 KM. This line is terminating into natural Rivulet/Stream. As per drawing obtained during visit, 03 Kuccha waste stabilization ponds (WSPs) have been proposed at terminal point. These tanks are located within the Rivulet/Stream. No pumping

station etc. has been constrt1icted for this work and water will flow into the line through gravity.

12- On the day of inspection work of laying of pipe was completed and it was connected with village drain in front of Baba Bhaiya Mandir (left side drain). Excavation of WSPs was in progress. On basis of drawing some final works were remaining.

13- For assessing quality of drain water, Sample of water diverted into pipeline in front of Baba Bhaiya Mandir was collected from entry point of pipe line and analyzed in Regional office RSPCB lab.

14- The team also discussed the issues with applicant Sh Kuldeep. It was intimated by him that all of his grievances have been mentioned in the Original Application and no separate issue is there regarding site visit.

Learned counsel for the applicant submitted that the quality of water is being deteriorating and the Rajasthan SPCB has examined the water quality and reported as follows:-

On the basis of the report, learned counsel for the applicant submitted that source of raw water for the village are PHED water supply and own bore wells constructed in many houses. There is no proper drainage system and treatment facilities and it is reported that Zila Parishad, Alwar, has planned drainage work providing closed pipelines from selected terminal points and amount has been sanctioned for completion of the work.

Only prayer of the learned counsel for the applicant is that the pipeline which is under construction should be completed within a time frame.

Accordingly, we direct the respondent, Municipal Corporation, to complete the pipeline work in Gram Panchayat Joria towards the Chawandi rivulets and have to better connectivity of the water pipeline and to ensure that there should not be any discharge of untreated water into the open land damaging the agricultural fields of agriculturists and causing health hazards. The work should be completed within a time frame.
