This appeal is directed against the order dated 01.10.2024 passed by appellate authority constituted under Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution), 1974 levy environmental compensation.

There is a delay of 30 days in filing the appeal. Hence, IA No.140/2025 has been filed by the appellant seeking condonation of delay. Reason for the delay is stated in the application and it has been pointed out that delay took place in collecting and collating all the data and records and seeking legal advice.

Delay is condonable as it is within the extended period of 60 days in

terms of proviso to Section 16 of National

Green Tribunal Act, 2010.

We find that delay has been sufficiently explained and it is unintentional and also for the bona-fide reason. On due consideration, IA No. 140/2025 is allowed and delay in filing the appeal is condoned.

Learned Counsel for the respondent seeks four weeks’ time to file the reply. Rejoinder, if any, be filed within two weeks thereafter.

Respondent is directed to produce a copy of the original records leading to passing of the impugned order in this appeal.
