This Original Application under Sections 14 and 15 of National Green Tribunal Act, 2010 was registered on a complaint/letter petition dated 09.08.2022, received from Sh. Hanuman Prasad Gupta, resident of Ward No. 14, Khasra No. 344, New Nandi Vihar Colony, Satrik Road, Chinhat, Lucknow, complaining that Aata, Tel and Masala workshop (Karkhana) has been established and being run with a heavy Eisher Diesel Set by its proprietor, Sh. Harsh Chauhan. It was established at the residential plot where Smt. Anita w/o Sh. Surender Chauhan is a caretaker.

Taking cognizance suo moto, Tribunal impleaded State of Uttar Pradesh through District Magistrate, Lucknow, Uttar Pradesh Pollution Control Board, through its Member Secretary and M/s. Harsh Flour Mill, Ward no. 14, BharwaraMalhaur, Chinhat, Lucknow through (i) Proprietor Mr. Harsh Chouhan and (ii) caretaker Ms. Anita w/o Mr. SurenderChouhan as respondents 1, 2 and 3 vide order dated 21.03.2024 and notices were issued.

Notice was also issued to respondent 3 through District Magistrate, Lucknow.

Tribunal also constituted a Joint Committee comprising representatives of UPPCB and District Magistrate, Lucknow and directed them to visit the site, find out factual position and submit Factual Report after making inspection in the presence of applicant and representative of the concerned project proponent.

Pursuant to order dated 21.03.2024, a Report dated 01.05.2024 has been filed through Regional Officer, UPPCB, Lucknow stating that a Joint Inspection was conducted on 25.04.2024 in presence of the complainant Sh. Hanuman Prasad Gupta and Sh. Manoj Chauhan (Proprietor) S/o Sh. Ram Pyare Chauhan, representative of the proponent. During inspection, it was found that no activity was being carried out at the site and M/s Harsh Flour Mill, Ward No. 14, Bharwara Malhaur, Chinhat, District Lucknow was completely closed.

Sh. Manoj Chauhan, representative of proponent also informed that concerned Aata Chakki has been completely closed for the last three months and this was verified by the complainant- Sh. Hanuman Prasad Gupta and he had no further complaint.

In view of the above Report, we do not find that any further action /order is required to be passed in this matter.
