This OA has been registered on the basis of the letter petition received from one Khurshid Alam resident of Trilok Puri, Delhi. The complaint of the Applicant is that at Kotla gaon within the limits of Police Station – Pandav Nagar, East Delhi one Hari Singh is raising illegal construction next to Nirankari Bhawan in the Delhi Development Authority (DDA) park and the illegal construction is protected by the officials of Municipal Corporation and DDA. As per the allegation no requisite permission has been taken by the person concerned and on that piece of land, the land grabbers are dumping the garbage and getting the work of its sorting done through the poor children.

The OA raises issue relating to the compliance of environmental norms.

We are of the opinion that the complaint raised by the Applicant needs to be first examined by the Member Secretary, Delhi Pollution Control Committee (DPCC).

Hence, we disposed of the OA with the direction to the Member Secretary, DPCC to get the spot inspection done and ascertain the truthfulness of the allegation and if the allegations are found to be true then take appropriate remedial action in accordance with law.

Let the action taken report be submitted before the Registrar General of the Tribunal within three months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF and if found necessary the matter will be listed before the Bench for consideration.

OA is accordingly disposed of.

A copy of this order, along with a copy of the letter petition, be forwarded to the Member Secretary, DPCC by e-mail for necessary action.
