The Registry has sent information to the applicant through e-mail dated 01.05.2024 about the hearing fixed in the matter today. But despite repeated calls, none has appeared from the side of applicant.

This Original Application has been registered pursuant to a complaint received from the applicant i.e. General Secretary, All India Forward Bloc, alleging therein respondent No.1- Sanwariya Processors Pvt. Ltd., Address: 405, GIDC, Pandesara, Surat,, is running a Mill, which burns restricted wood for producing water steam for mill boiler, resulting in emission of heavy polluted black fog in the nearby area, which is dangerous to the public health and is leading to various diseases such as T.B. & Bronchitis.

Based on the above-mentioned complaint, we had directed the Registry by our previous order dated 19.02.2024 to call for a report from

the Member Secretary, Gujarat Pollution Control Board (GPCB) regarding truthfulness of the contents made in the complaint.

In response thereto, a report from the Gujarat Pollution Control Board (GPCB) has been received through e-mail dated 26.04.2024, which is annexed at page nos.10 to 33 of the paper book, relevant part of which is quoted herein below:-

From this report, it is evident that during the inspection made by the respondent No.2-GPCB on 28.02.2024, respondent No.1- Sanwariya Processors Pvt. Ltd. was observed in operation and Dyeing of Grey Cloths was going on, which has been granted CC&A dated 30.12.2020, which is valid till 30.11.2025.

The above-mentioned report discloses that GPCB has not found any violations/non-compliances on the part of respondent No.1Sanwariya Processors Pvt. Ltd., which was alleged to have burnt restricted wood for producing water steam for mill boiler due to which huge black smoke was said to have emitted in the local area causing air pollution. It is also recorded in this report that the fire wood was included in the list of approved fuels. A copy of the said Notification dated

In view of above report of the Gujarat Pollution Control Board (GPCB), we find no ground to pass any direction to the said respondent in this application and dispose of this application accordingly.
