On a letter petition dated 19.12.2023 sent by Surender Kumar Metho, the present Original Application has been registered under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘ NGT Act, 2010 ’) exercising suo-moto jurisdiction in view of law laid down by Supreme Court in Municipal Corporation of Greater Mumbai Versus Ankita Sinha and Others, (2022) 13 SCC 401.

Complainant has said that there is a Health Care Facility namely M/s Steel City Nursing Home, Bistupur, District Jamshedpur, which is not properly handling bio-medical waste. It is dumping bio-medical waste openly which is endangering people’s health and thereby violating environmental laws.

In our view, complaint made in the present application can effectively be addressed, at the first instance, by District Authorities and Statutory Regulator.

We accordingly, direct Jharkhand State Pollution Control Board to examine complaint, visit the site, collect relevant information and if finds any violation of environmental laws or any laxity in handling, management and disposal of biomedical waste on the part of Health Care Facility, appropriate preventive, punitive, prohibitive and remedial action shall be taken in accordance with law within one month.

With the above directions, this Original Application is disposed of.

Copy of this order be forwarded to Jharkhand State Pollution Control Board by e-mail for compliance.
