This M.A has been filed by one of the former Expert Member of the Tribunal in OA No. 199/2014 seeking a direction to the CPCB to clear the bills submitted by him for the exercise undertaken by him as a member of the Joint Committee. The applicant was one of the independent Expert Members of the Joint Committee, which was constituted by the Tribunal in OA No. 199/2014. The applicant's plea is that the Tribunal vide order dated 20.04.2017 had directed the payment to be made to the members of the Committee and that the Committee had completed the work as directed by the Tribunal and submitted the report. Still, the various bills submitted by the applicant, the details of which are contained in paragraph 19 of the M.A., have not been cleared.

Ld. Counsel for the CPCB submitted that clearing the bills was difficult since the applicant had not furnished the details of the site visits

and also the details of the report/reports submitted to the NGT. He has submitted that if these details are furnished, the bills will be examined and cleared within two months.

Though, learned senior counsel for the applicant has taken the stand that earlier no such details were asked by the CPCB and the bills have been unnecessary kept pending but the applicant has no objection in furnishing the above details desired by the CPCB.

The learned senior counsel for the applicant has also submitted that in furtherance of the order of the Tribunal dated 10.03.2017 in OA No. 199/2014, the MoEF & CC by order dated 17.10.2017 had constituted various Sub-Committees and in terms of the said order, the payment was required to be made to the members. He has also submitted that based on the MoEF & CC order, the Government of Uttar Pradesh had issued the order dated 02.04.2018 constituting the State Level Committee, wherein the applicant was appointed as Chairman, therefore. for his work as Chairman of the committee, the payment is required to be made, so far as these claims are concerned, the same may also be examined by the CPCB in accordance with law within two months, and the due amount be paid.

Hence, we disposed of the M.A. permitting the applicant to furnish the details as mentioned above, required by the CPCB and on furnishing the same, the CPCB will clear the bills of the applicant as per law within two months.
