of the houses of the villagers. The committee consisting Dy. Collector, Balotra, Tehsildar Kalyanpur and Commissioner Municipal Council Balotra has suggested five measures. We recommend that all these five measures should be implemented at the first stage.

Learned Counsel for the Municipal Council Balotra has suggested that industrial waste from the industrial area of the Jodhpur are flown towards Balotra running from 60 kms. (approximately) which is not within the territorial jurisdiction of Municipal Council Balotra and thus Municipal Corporation, Jodhpur being proper and necessary party should be impleaded as respondent.

Accordingly, we direct that the Municipal Corporation, Jodhpur be impleaded as respondent. Learned Counsel for the State PCB is directed to serve the notice to the Municipal Corporation, Jodhpur to submit the reply within four weeks.

Learned Counsel for the CPCB Mr. Yadvendra Yadav has filed the reply in O.A No. 137/2024 and submitted that the appeal which is stated to be pending is against the EC to the tune of two crores against the violators. We are not concerned with the matter which is pending with the Hon’ble Supreme Court of India and it is not desirable to intervene. So far as the compliance report submitted by the Learned Counsel for the State is concerned, the committee constituted vide order dated 09.05.2024 submitted the report which has been filed by the respondent no. 3, submitted that provisions for construction of STPs have been taken and some of

the of STPs are under construction and rest are at the stage of commissioning. There are certain recommendations of the committee and action initiated at the District Level.

Accordingly at the primary stage without going to the merit of the case, we direct that the recommendations and actions initiated at the district level as suggested by the District Collector, Jodhpur should be implemented in letter and spirit and should be expedited as early as possible and the further progress report in light of the report filed on 29.07.2024 be submitted before this Tribunal within four weeks.
