This original application was listed on 27.05.2024. Since no one had appeared on that date for the applicant, therefore the case was adjourned to 13.09.2024.

Applicant has filed I.A. No. 261/2024 seeking early hearing of the OA. Submission of counsel for the applicant is that due to inadvertence he could not see the cause list and could not appear in the matter.

On due consideration I.A. No. 261/2024 is allowed and OA is taken up today for hearing on admission.

In this original application, the applicant has raised a grievance against the ongoing construction of Rail Bridge between Daraganj and Jhunsi which is stated to be on the floodplain. Further grievance of the

applicant is that the bridge is being constructed in violation of the provisions of River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016. Learned counsel for the applicant has placed reliance upon clause 42 of the said order which reads as under:-

“ (42) कततऩम भाभरों भें ऩूर्व अनुभोदन देना- प्रत्मेक व्मक्तत याज्म गंगा समभततमां , क्जरा गंगा संयऺण समभततमां औय स्थानीम प्राधधकयण तथा अन्म प्राधधकायी गंगा नदी से संफंधधत तथा गंगा नदी मा इसकी सहामक नददमों के दामये भें आने र्ारे ऺेत्र से संफंधधत तनम्नमरखित भाभरों ऩय , मदद याष्ट्रीम गंगा नदी के तनणवमों को कामावक्न्र्त कयना अऩेक्षऺत है , तो याष्ट्रीम स्र्च्छ गंगा मभशन का ऩूर्व अनुभोदन प्राप्त कयना होगा। नाभत्( क) गंगा नदी के डाउन स्रीभ जर के प् र ाह को प्रबावर्त ककए बफना गंगा नदी भें जर के बण्डायण के डाइर्जवन की प्रणारी ;

( ि) गंगा नदी मा नदी के तट ऩय मा इसके फाढ़ मोजना ऺेत्रों ऩय ऩुरों औय सहामक सड़कों तथा तटों का तनभावण ;

( ग) घाटों का तनभावण अथर्ा ककसी बी भौजूदा घाट का वर्स्ताय ; ( घ) घाटों का तनभावण ; ( ड.) जर के संग्रह अथर्ा डाइर्जवन मा तनमंत्रण के मरए स्थामी जरीम संयचनाओं का तनभावण अथर्ा गंगा नदी अथर्ा इसकी सहामक नददमों का चैनरीकयण ; ( च) ऩहाड़ी ढरानों औय अधधसूधचत र्न तथा अन्म ऩमावकृष्ट्णीम दृक्ष् ट ् से संर्ेदी ऺे त्रों का र्न कटार् ;

( छ) कोई अन्म कामवकराऩ जो कक ऩैयाग्राप 4 भें मसदधांतों के वर्ऩयीत तनधावरयत ककए गए हैं उन्हें याष्ट्रीम स्र्च्छ गंगा मभशन दर्ाया वर्तनददवष् ट ् ककमा जाए। “

Referring to the said clause he has submitted that for the construction of the bridge over the River Ganga or its river bank or its flood plain area the approval of the NMCG is required which has not been obtained in the matter. In support of his submission he has also placed reliance upon the communication dated 06.11.2023 (Page 84) sent by the NMCG to the District Magistrate, Prayagraj raising objection to the construction of the said bridge. Further submission of counsel for the applicant is that in the course of construction of the bridge the soil is being dumped in the river bed disturbing the ecology of the river.

The OA raises substantial issue relating to compliance of environmental norms.
