I.A. No.56 of 2022 (SZ):

1. This is an interlocutory application [I.A. No.56 of 2022 (SZ)] filed by the 3^rd Respondent/MoEF&CC to condone the delay in filing the written statement and to waive the cost imposed by this Tribunal.

2. Though we are not satisfied with the reasons stated in the application for delay, however, taking a lenient view, we allow this application. So, this interlocutory application is allowed and the delay is condoned and the counter statement filed by the 3^rd Respondent is received, waiving the cost imposed. With the above observations and directions, this interlocutory application [I.A. No.56 of 2022 (SZ)] is allowed and disposed of accordingly.

O.A. No.08 of 2021 (SZ):

3. The delay in filing the counter statement and waiver of payment of cost is allowed as per order in I.A. No.56 of 2022 (SZ) and the counter statement filed by the 3^rd Respondent/MoEF&CC is received.

4. As per order dated 09.02.2022, this Tribunal had considered the report submitted by the Tamil Nadu Pollution Control Board signed by the officer on 22.10.2021 and e-filed on 25.10.2021 and extracted in Para (2)

of the order and then directed the State Pollution Control Board to file

a detailed statement regarding the observations made by this Tribunal by order dated 17.09.2021 and posted the case to 08.03.2022 for completion of pleadings and consideration of further reports. On 08.03.2022, it was adjourned to today by notification.

5. No further report has been filed by the Tamil Nadu Pollution Control Board as directed by this Tribunal.

6. The Project Proponent is directed to file their statement as to what they were doing for collecting the biomedical waste before an agreement was made with an Agency and how the medical waste generated in their institution was disposed of.

7. The District Collector is also directed to file a report as to whether any buildings were constructed encroaching into the water body, as alleged in the application and whether construction debris and other waste generated in the medical college was dumped into the water body and if so, what is the nature of action taken from their side in this regard.

8. Whenever inspection is done, they are directed to give notice to the project proponent, so that the inspection can be done in their presence.

The State Pollution Control Board as well as the District Collector are directed to file their respective reports to this Tribunal on or before 06.04.2022 by e-filing in the form of Searchable PDF/OCR Supportable PDF and not in the form of Image PDF along with necessary hardcopies to be produced as per Rules and get ready with the matter on 08.04.2022 for hearing.

10. The Registry is directed to communicate this order to the District Collector and also to the Tamil Nadu Pollution Control Board by e- mail for their information and compliance of directions.

11. For consideration of further reports and hearing, post on 08.04.2022.
