27.08.2026 Learned Counsel for the Appellant submits that he is the Suspended Director of the CD, which is a profit-earning company having 182 employees.

In the meantime, Shri Pranab Thakkar appears and submits that the matter has been reserved by the Learned Adjudicating Authority and that the same may be disposed of on its own merits.

Learned Counsel for the Appellant, however, submits that he is ready to pay the whole of the amount as mentioned in the application moved by the Respondent/Applicant before the Learned Adjudicating Authority, within one month from today and to show its bonafide he may pay Rs. 25 lacs to the Operational Creditor/Respondent No. 1, at once.

We have considered the submissions made by Learned Counsel for the Parties. It is reflected that by passing the order dated 05.08.2026, the Learned Adjudicating Authority has recorded the submission made by Learned Counsel for the Appellant in terms that substantial amount has been paid to the OC and the

net amount of around Rs. 1 crore is left to be paid, while the counsel for the

Respondent/OC stated this amount to be of Rs. 1.26 crore and thereafter hearing the arguments the order has been reserved by Learned Adjudicating Authority.

After arguing at some length, Learned Counsel for the Appellant submits that the grievance of the Appellant may be redressed if he may be given liberty to move an appropriate application before the Learned Adjudicating Authority stating all the facts which he has argued before this Appellate Tribunal and in this scenario the appeal may be dismissed as withdrawn.

Keeping in view all the facts and circumstances of this case, the appeal filed by the Appellant is dismissed as withdrawn, with the liberty that the Appellant may immediately move an appropriate application before the Learned Adjudicating Authority stating therein all the submissions which he has made before this Appellate Tribunal and if such an application is moved, before the pronouncement of order by the Learned Adjudicating Authority, the Learned Adjudicating Authority may consider the same in right perspective.
