Heard Mr. Murtaza Ahmed, learned counsel for the petitioner; Mr. S. Niranjan, learned Government Advocate and Mr. H. Kenajit, learned counsel for the respondents.
Mr. Murtaza Ahmed, learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to file a fresh one with the same cost as there is defect in the name of the parties in the petition.
Mr. S. Niranjan, learned Government Advocate for the State respondent and Mr. H. Kenajit, learned counsel for the LDA submitted that this Court may pass appropriate order with respect to the prayer made by the learned counsel for the petitioner considering the submission made at the Bar.
The present writ petition is dismissed as withdrawn with liberty to file a fresh with the same cost, if so advised.
