Mr. N. Ibotombi, learned senior counsel assisted by Mr. Th. Ningtamba, learned counsel appeared on behalf of the applicant and Mrs. L. Monomala, learned GA appeared on behalf of the respondents.

WP(C) No. 652 of 2023 was filed by 132 writ petitioners with a prayer for quashing and setting aside the impugned order dated 16-08-2023 issued by the Commissioner (Higher & Technical Education), Government of Manipur and also the second part/portion of the para No. 14 of the impugned order dated 07-01-2022 issued by the Secretariat; Higher & Technical Education Department, Government of Manipur and also for issuing a direction to the respondents to count/link up the uninterrupted part time services rendered by of the petitioners for all purposes.

The present applicants (28 in number) who are arrayed as petitioners No. 90, 62, 63, 67, 71, 77, 80, 82, 83, 91, 92, 94, 95, 97, 102, 104, 105, 106, 107, 109, 117, 121, 123, 125, 126, 128, 129 & 132 respectively in the said writ petition, filed the present application with a prayer to allow withdrawing themselves from the WP(C) No. 652 of 2023 with liberty to file a fresh petition if so advised.

It has been submitted by the learned senior counsel appearing for the applicants that due to subsequent changes and certain circumstances, the applicants are desirous of withdrawing themselves from being the co-petitioners in the above referred writ petition with the liberty to file a fresh petition if so advised. The learned senior counsel, accordingly, prays for allowing the present application.

Mrs. L. Monomala, learned GA appearing for the respondents fairly submitted that she has no objection in allowing the present application.

In view of the submission made by the learned counsel appearing for the parties, this Court is of the considered view that the present application can be allowed.

Accordingly, prayer made in the present application is hereby allowed with the liberty as sought for.

Consequently, Registry is directed to delete the names of the applicants from being the array of parties in the connected writ petition.

With the aforesaid directions, the present application stand disposed of.
