[1] Captioned MC (Miscellaneous Case) has been filed with a condonation of delay (CoD) prayer qua 425 days delay in filing an intra Court appeal i.e., WA (Writ Appeal).

[2] When the matter was taken up, it came to light that the reasons have not been articulated with details in the MC application. [3] Faced with the above situation, Mr. Abdul Baqee Khan, learned counsel on record for MC applicant sought leave of this Court to withdraw the captioned MC application and made a further plea to preserve all the rights and contentions of MC applicant to file another MC application with the same prayer on the same subject setting out better and detailed particulars regarding reasons for delay. These requests for permission for withdrawal and preservation of rights are acceded to. In this regard, a scanned reproduction of endorsement made by learned counsel on record for MC applicant in the case file is
