[1] Mr. Ajoy Pebam, learned counsel appeared on behalf of the

applicant and Mrs. I. Lenibala, learned counsel appeared on behalf of

[2] MC (Rev. Pet (J2)) No. 3 of 2026 had been filed with a prayer for condoning the delay of 298 (two hundred ninety-eight) days in filing the accompanying Review Petition against the order dated 04.09.2025 passed in Mat. App. No. 8 of 2025 and connected MC (Mat. App.) No. 12 of 2025.

[3] MC (Rev. Pet (J2)) No. 4 of 2026 had been filed with the following prayers:-

“(a) pass an ex-parte interim order permitting the Applicant/Petitioner to meet and spend time with his two minor children, Master Ranej Yumnam and Miss Nejirin Yumnam, at Shillong for 7 (seven) days during the coming week, on such date, time and reasonable conditions as this Hon'ble Court may deem fit;

“(b) direct the Respondent to facilitate and cooperate in handing over/accessing the minor children for the said limited 7 days meeting and not obstruct or prevent the Applicant from meeting them;

¶24

“(c) permit the Applicant to meet the children in a peaceful and child- sensitive manner without disturbing their schooling, education, health or normal routine;

¶25

“(d) permit dasti service through the Ld. counsel for the Respondent to facilitate expeditious service while also ensuring that the Respondent is duly informed of the present application and the interim relief sought therein; and

¶26

“(e) pass such further order or direction as this Hon'ble Court may deem fit and proper in the interest of justice and welfare of the minor children.”

04.09.2025 passed by a coordinate Bench of this Court in Mat. App. No. 8 of 2025 & in MC (Mat. App.) No. 12 of 2025 and also for directing the learned Mediator for reviewing the settlement agreement dated 12.08.2025 arrived at between the present applicant and the present respondent.

[5] When these matters are taken up today, the learned counsel appearing for the applicant submitted that the applicant is presently undergoing training on deputation at Japan and that he is presently at Imphal, availing holidays. It has also been submitted that the applicant will be going back to Japan after expiry of his holiday period, i.e., on 19.09.2026.

It has been also submitted on behalf of the applicant that before going to Japan again, the applicant desires to meet his wife, who is the respondent herein and his 2 (two) minor children.

It has been submitted before us that the respondent and the 2 (two) small children are presently residing at Shillong.

[6] The learned counsel appearing for the applicant submitted that the applicant is willing to go to Shillong on 11.09.2026 so that he can meet his wife and his 2(two) children on 12.09.2026 and 13.09.2026.

[7] The learned counsel also submitted that the present 2 applications as well as the accompanying review petition can be closed if the applicant is given visitation rights to meet his wife and their 2 (two) small children at the place where all of them are residing at Shillong. It has also been submitted that the applicant be given 3 hours visitation rights to meet his 2 (two) children and his wife at the place where they are presently residing at Shillong on 12.09.2026 and 13.09.2026 between 9:00 am to 4:00 pm of both the said 2 (two) days.

[8] Mrs. Lenibala, learned counsel appearing for the respondent submitted that at an earlier point of time when the applicant visited the respondent and their 2 (two) small children, the applicant came along with other persons and he seemed to be in an intoxicating state and acted rudely. It has also been submitted that in view of the earlier incident, unless the applicant come alone, the respondent have apprehension that the petitioner may behave in the same way.

[9] The learned counsel appearing for the respondent submitted that if the applicant come alone to meet his 2 (two) children at the place where they were presently residing, the respondent has no objection. However, the counsel for the respondent submitted that

the applicant may be restrained from taking out either the respondent

or his 2 (two) small children from the place of their residence without their consent and agreement. The learned counsel further submitted that prior information about the timing of the visit of the applicant may be intimated to the respondent in advance so that the respondent can arranged for cordial meeting of the applicant and his children.

[10] Taking into consideration the submission advanced by the learned counsel appearing for the parties, we are satisfied that both the present 2 (two) applications as well as the accompanying review (yet to be numbered) can be closed by issuing the following directions:-

1. The applicant is given liberty to visit and meet the respondent and his 2 (two) small children at the place where they are residing presently;

¶47

The applicant is permitted such visitation rights for a duration of 3 hours only on 12.09.2026 and 13.09.2026 between 9:00 am – 4:00 pm on both days;

The applicant should give prior information to the respondent about the timing of his visit so that the respondent can arrange for their smooth meeting;

It is made clear that the applicant can take out and spend some time either with the respondent or his 2 (two) children during the said 3 hours, if the respondent and the children agree to do so;

It is also made clear that the applicant should not forcibly try to take out either the small children or the respondent without their consent.

[11] In order to safeguard and to allay the fear and apprehension expressed by the respondent, we request the Member Secretary, State Legal Services Authority, Meghalaya, to depute one officer to oversee the meeting of the applicant with his wife and children as indicated above and to submit a report to the Registrar General, High Court of Manipur in that regard.

[12] The Member Secretary, Manipur Legal Services Authority is directed to communicate a copy of this order to the Member Secretary, State Legal Services Authority, Meghalaya with a request to facilitate and oversee the meeting of the applicant with his wife and children and also to ensure that the contact numbers of both the applicant and the respondent are furnished to the Member Secretary,

[13] The communication of this order shall be done forthwith.
