The petitioner has filed the present Writ Petition seeking a direction to respondents 1 to 4 to remove the encroachment allegedly made by the sixth respondent in the Government poramboke highway road situated in Survey Field No.159 of Kallapalli Village, Krishnarayapuram Taluk, Karur District, based on the petitioner’s representation dated 28.02.2026.

2.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

3.Considering the limited relief sought by the petitioner, notice

to the sixth respondent is dispensed with.

4.It is the contention of the petitioner that the sixth respondent is

carrying on business by selling duck meat and related food items on the roadside. It is further stated that customers gather at the said place and park

their vehicles on the road margin, thereby obstructing the free flow of traffic. The petitioner also alleges that waste generated from the said activity is being indiscriminately dumped along the roadside, near the petitioner’s land and water channel. As a result, stray dogs and other animals drag the meat waste into the adjoining agricultural fields, and the remnants attract snakes, posing a danger to the petitioner and agricultural workers. According to the petitioner, the land in Survey No.159 is classified as a highway poramboke, and it is the duty of the authorities to prevent encroachments thereon. In this regard, the petitioner submitted a representation dated 28.02.2026 before the authorities concerned. As the same has not been considered thus far, the present Writ Petition has been filed.

5.The learned Additional Government Pleader appearing for respondents 1 and 3 to 5, on instructions, submitted that the petitioner’s representation dated 28.02.2026 would be considered and that the fourth respondent would conduct a survey of the land in question in the presence of all concerned parties. It is further submitted that if any encroachment is

found, the same would be reported to the second respondent, who would take appropriate action for its removal.

6.Having regard to the above and considering the statutory obligation of the authorities to protect Government poramboke lands from encroachment, this Court directs the fourth respondent to conduct a survey of the subject land, after issuing notice to the petitioner, the sixth respondent, and all other necessary parties, within a period of two weeks from the date of receipt of a copy of this order. If the survey reveals any encroachment, the fourth respondent shall submit a report to the second respondent/Project Director, National Highway Authority. Upon receipt of such report, the second respondent shall initiate appropriate proceedings under the relevant provisions of law and take steps for removal of the encroachment, after issuing statutory notices, affording an opportunity of personal hearing to all parties concerned, and pass reasoned orders, strictly in accordance with due process of law, within a period of three months thereafter.
