This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent / District Revenue Officer to consider the grievance of the petitioner in respect of the appeal pending before him in Na.Ka.No.2797274/2024/A4, as communicated through letter dated 03.10.2025,

by affording an opportunity of personal hearing, verifying the relevant documents, and to pass appropriate orders on merits, based on the petitioner’s representation dated 23.12.2025, within a time frame to be fixed by this Court.

2 . By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3 . Since no adverse orders are going to be passed against the third respondent, notice to the third respondent is hereby dispensed with.

The learned counsel for the petitioner submits that the petitioner is the absolute owner and in lawful possession of the lands situated at Sitharkalnatham Village, Nilakottai Taluk, Dindigul District, bearing Plot Nos.117/13 and 117/14A, presently comprised in Patta No.3957, which originally stood in Patta No.939. The said properties were originally owned by the petitioner’s grandfather, Kamakshi Naickar, who initially possessed the lands under an earlier deed and subsequently acquired absolute title by way of registered sale deeds from the year 1966 onwards. During his lifetime, the petitioner’s grandfather executed a registered deed dated 09.09.1987, whereby he clearly divided and settled his properties in favour of the respective beneficiaries according to his wishes, under which the petitioner derived his right over the subject lands. Taking advantage of the petitioner’s absence and without any notice or enquiry, Rajapandi, son of Maasinaickar (third respondent), illegally secured transfer of patta in his favour in the year 2023, claiming title based on an alleged sale deed of the year 2002, which is false, invalid, and not binding on the petitioner. On coming to know about the illegal patta transfer, the petitioner approached the Revenue Divisional Officer seeking cancellation of the said patta. However, the

petition was dismissed without proper appreciation of facts and documents. Aggrieved by the dismissal, the petitioner preferred an appeal before the District Revenue Officer (second respondent), which is pending. Despite the petitioner submitting a further representation dated 23.12.2025, requesting personal hearing, verification of documents, and early disposal of the appeal, the second respondent has not passed any orders till date.

5 . The learned Additional Government Pleader appearing for the respondents 1 and 2 submits that the petitioner's appeal will be considered and disposed of on merits and in accordance with law within a time frame to be fixed by this Court.

Recording the aforesaid submission and without going into the merits of the matter, this Court directs the second respondent to consider the petitioner's appeal and dispose of the same on merits and in accordance with law, after affording due opportunity to all the parties concerned, within a period of four months from the date of receipt of a copy of this order.
