The learned counsel for the petitioner submitted that Survey No. 205/11A, measuring an extent of 2.33 ares, is jointly owned by the petitioner along with 30 others, and a joint patta has been issued in Patta No.3335. While so, the 6^th respondent who is one of the co-owner among 30 people executed a sale deed in Document No.617 of 2026 in favour of the 7^th respondent for an extent of 4 cents. It is further submitted that the 6^th respondent had earlier filed WP(MD) No.30777 of 2025 before this Court, which was disposed of on 02.12.2025. The learned counsel contended that the property remains undivided under a joint patta, and even if subdivided, each co-sharer would be entitled to only about 80 square feet. In such circumstances, the sale of 4 cents by the 6^th respondent adversely affects the petitioner’s rights. Hence, the petitioner seeks appropriate orders for consideration of the same.

Heard the learned Special Government Pleader appearing for the respondents 1 to 5.

Considering the facts and circumstances of the case, this Court directs the respondents 1 to 5 are directed to restore the joint Patta and cancel the

individual Patta issued in the name of the 6^th and 7^th respondent. The parties are at liberty to approach the competent civil court to establish their rights and thereafter the revenue authorities shall subdivide the property as per the judgment.
