PRAYER:- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus calling for the entire records pertaining to the Impugned Order of the ICC committee Report in Na.ka.No. 3444/A6/2025 dated 06.02.2026 approach conducted by the 2nd respondent and quash the same as illegal and consequently direct the 2nd Respondent to conduct a fresh inquiry by granting an opportunity for the petitioner to cross-examine the witnesses., within a time stipulated by this Court.

This writ petition has been filed challenging the ICC Committee report mainly on the ground that the petitioner was not afforded with reasonable opportunity of cross-examining the witnesses and also to examine witnesses on his behalf. .

The matter came up for consideration before this Court on 17.03.2026 and the same was adjourned requiring the respondents to file a counter affidavit.

Today, when the matter is taken up again for consideration, it is brought to the notice of this Court that further action has been taken pursuant to the impugned ICC Committee report dated 06.02.2026 and a final order has been passed by the competent authority as early as on 02.04.2026 imposing the punishment of compulsory retirement and the said proceeding was already served on the petitioner as early on 06.04.2026. A copy of the Tamil version of the said proceedings is produced before this Court.

In the light of the above, it is for the petitioner to take appropriate steps against the proceedings dated 02.04.2026 and in

the absence of the same, no other inquiry need to be conducted. In those circumstances, this writ petition is dismissed granting liberty to the petitioner to take appropriate steps against the proceedings bearing Na.Ka.No.002231/I3/2021 dated 02.04.2026. It is made clear that all the grounds that are raised in the present petition are left open to be agitated by the petitioner while challenging the proceedings dated 02.04.2026. No costs. Consequently, connected miscellaneous petitions are closed.
