PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a WRIT OF Certiorarified Mandamus, calling for the records relating to the impugned proceeding issued by the 3rd respondent Chief Educational Officer in Na. Ka. No. 3308/A6/2025 dated 05.12.2025, quash the same and further direct the 3rd respondent Chief Educational Officer to approve forthwith the appointment of Jeba Selin Mary as PG Assistant in Zoology in the petitioners school namely, Yettacode Higher Secondary School, Veeyannoor, w.e.f. 10.06.2024 and disburse the grant-in-aid towards her salary and allowances w.e.f., the said date with all attendant benefits.

The petitioner has filed this Writ Petition challenging the impugned proceedings issued by the third respondent the Chief Educational Officer in Na.Ka.No.3308/A6/2025, dated 05.12.2025, quash the same and further direct

the respondents 3 to approve forthwith the appointment of Jeba Selin Mary as PG Assistant (Zoology) in in petitioner's school w.e.f the date of her appointment viz., 10.06.2024, with all attendant benefits including the arrears of salary and allowances.

The learned counsel for the petitioner would submit that the issue raised in the writ petition is covered by a judgment of the another Single Judge passed in W.P.No.4735 of 2017 dated 15.04.2019 and she also circulated the aforesaid judgment.

According to learned counsel for petitioner, Mrs. Jeba Selin Mary had completed S.S.L.C in the State of Kerala, which was treated on par with the educational qualification of S.S.L.C in the State of Tamil Nadu and she possess the minimum educational qualification prescribed for the post of PG Assistant (Zoology).

A perusal of the judgment relied upon by the learned counsel for the

petitioner would indicate that this Court had relied upon an earlier judgment as affirmed by the Hon'ble Division Bench and the Hon'ble Apex Court, in that regard, holding that such certificate issued by the State of Karnataka to be a valid certificate, by considering the petitioner therein had also completed further education on the certificate issued by the State of Karnataka.

In the present case also, Mrs. Jeba Selin Mary after completing her S.S.L.C had done her higher education in the State of Tamil Nadu and also been permitted to write a public examination. If that be so, on having treated a pass in SSLC as eligible she had also obtained a B.Sc., in Zoology in the year 2006, B.Ed., in the year April 2007, M.Sc., Zoology in the year April 2015 and M.Phil in the year 2017 from the Manonmaniam Sundaranar University, Tirunelveli in the State of Tamil Nadu.

In such view of the matter, I am of the view that the judgment relied

upon by the petitioner is squarely applicable to the facts of the present case.

Hence, this Writ Petition stands allowed and the respondents are directed to approve the appointment of Mrs. Jeba Selin Mary as PG Assistant in Zoology in the petitioner's school with effect from her date of appointment i.e., 10.06.2024 with all consequential benefits be paid to her within a period of twelve weeks from the date of receipt of a copy of this order. No order as to costs. Consequently, connected Miscellaneous Petition is closed.
