PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a WRIT OF MANDAMUS, directing the 1st Respondent to issue No Objection Certificate for the location of the 2nd Respondents Retail Outlet in the land comprised in Survey No. 145/3A2, Narippaiyur, Sayalkudi, Kadaladi Taluk, Ramanathapuram District in the light of the NOC issued by the 1st Respondent dated 15.11.2017 based on the request made by the. 2nd Respondent vide communication dated. 25.08.2025 within a time frame as fixed by this Honble Court and to pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

The writ petition is filed for a mandamus directing the 1^st respondent to issue No Objection Certificate for the location of the Retail Outlet on behalf of the 2^nd respondent namely Territory Manager (Retail), Bharat Petroleum Corporation Ltd., Madurai Retail Territory.

Heard Mr.B.Prahalad Ravi, learned counsel for petitioner and Mr.M.lingadurai, learned Special Government Pleader, who takes notice for R1.

By consent, the writ petition is taken up for final disposal at

the admission stage itself. Since no adverse orders are to be passed against the 2^nd respondent, notice to the 2^nd respondent is dispense with.

When the matter came up for admission today, the learned Special Government Pleader taking notice on behalf the 1^st respondent would submit that the application submitted by the petitioner will be considered and orders will be passed on merits and in accordance with law.

The 1^st respondent is directed to consider the application of the petitioner and issue No Objection Certificate (NOC) in accordance with law after due notice to the petitioner and the second respondent, within a period of eight weeks from the date of receipt of a web copy of this order, without waiting for the certified copy of the order. No costs.
