Challenging the order passed by the Tahsildar Muthukulathur Taluk issued under Section 6 of the Land Encroachment Act (in short 'the Act'), the present writ petition is filed to quash the same as illegal.

The learned Additional Government Pleader submitted that this is a second round of litigation by the petitioner herein. Earlier when similarly placed persons filed writ petition challenging the notice issued under Section 7 of the Act, this Court dismissed the writ petition with liberty to file appeal under Section 10(A) of the Act. After disposal of the appeal by the District Collector, the authorities have issued notice under Section 6 of the Act to all the encroachers including the petitioner herein. The said notice is now under challenge.

We are not inclined to entertain the writ petition since the Statute provides for revision. Without exploring the statutory remedy available, filing

the writ petition to quash the notice without any valid grounds cannot be entertained. Hence, the writ petition is dismissed. It is open to the petitioner to prefer statutory revision, if he is so advised. No costs. Consequently connected Miscellaneous Petitions are closed.
